Any service rendered on the Herbs Yin Yang website, herbsyinyang.com, implies the buyer’s unreserved acceptance of these terms and conditions of sale.

Prerequisite for ordering products

All orders placed on the website herbsyinyang.com, hereinafter referred to as the “Site”, imply the opening of a personal account and acceptance by the Customer of these terms and conditions of sale.

These general terms and conditions of sale may be subject to change. The applicable terms and conditions are those in force on the Site at the time the order is placed.

Products

Prior to placing an order, the purchaser may review the essential characteristics of the desired products on the herbsyinyang.com website, using the “Product sheet” and “Learn more” sections appearing on each product page. Offers presented by herbsyinyang.com are subject to availability from its suppliers.

The descriptions in the “Product sheet” and “Learn more” sections, as well as the photographs and help pages, are not contractually binding. Herbs Yin Yang cannot be held responsible for any errors. All texts and images presented on the online store herbsyinyang.com, are reserved, for the whole world, with the royalty and intellectual property; their reproduction, even partial, is strictly prohibited.

Period of validity of sales offers

Products are offered for sale while stocks last. In the event of an order for a product that has become unavailable, the customer will be informed of this unavailability as soon as possible by e-mail or post.

Order

Before finalizing any order, you will be asked to accept the present conditions of sale.

For payments by Visa, Mastercard, credit card (CB) or Paypal, the customer’s order is validated once the payment has been made on the chosen payment platform, and provided it has been accepted.
Before validation, the customer may go back at any time to check each element of the order and correct it if necessary.

The Site confirms the customer’s order by e-mail; the information contained therein includes all the elements of the order, the type of shipment and the method of payment.
Customers can find the invoice for their order in their customer account (if they opened a store account when they placed their order), in the “Order history and details” tab.

The data recorded by the Site constitutes proof of the nature, content and date of the order.

The Site herbsyinyang.com reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order.

The information provided by the purchaser on the Site when placing an order is binding on the purchaser: in the event of an error in the recipient’s contact details, the vendor cannot be held responsible for the impossibility of delivering the product.

If the customer requests to cancel the order immediately after paying for it, it will be reimbursed by bank transfer minus bank charges, or by Paypal (minus Paypal charges) if the customer has used this method of payment.

Prices

All our prices are given in euros and include VAT. We can ship to European Union countries without customs duties. Many countries do not impose import duties on private items below a certain declared value. We advise you to find out about local regulations before ordering from us.

The Site herbsyinyang.com reserves the right to modify its prices at any time, but the products ordered are invoiced at the price in force when the order is registered.

Payment

Payment in full is due upon validation of the order or, in the case of payment by bank transfer, upon receipt.

Payment for orders is made by :

Shipping

Packages are shipped from China and are usually dispatched within 48 to 72 business hours after receipt of your payment. More information on the delivery page.

Any cancellation of an order just after shipment will be reimbursed minus shipping costs, if the parcel can be blocked by the carrier.

Delivery

Once payment has been received, the order is processed within 48 to 72 working hours. The shipment will be made by a private carrier, or possibly the standard service of the Chinese Post Office, and will be delivered by the Chronopost/DPD carrier in your country. Shipping costs are at the buyer’s expense.

The sender is not responsible for any damage to the package caused by the carrier. The buyer is therefore responsible for checking the package upon arrival. He/she must carry out all necessary checks and make any reservations in the event of shortage or damage on receipt of the equipment in the presence of the delivery person, in order to exercise, if necessary, and within the statutory time limits, any recourse against the carrier.
If a refund is requested, a refund of the products purchased (excluding shipping costs) may be made, less bank or Paypal charges, depending on the case and once the return of the parcel has been confirmed by the carrier.

Delivery times are given as an indication only, and the Site cannot be held responsible for any delays. No compensation will be paid for delays.

If you are not present when the parcel is delivered, the driver will leave a delivery notice in your letterbox or send you an SMS, and will drop off your parcel either at the nearest post office or at a point relais. Your parcel will remain there for 14 days if in a post office, or 7 days if in a point relais.
After this period, it will be returned to sender and no refund will be made if you forget to collect your parcel from the post office or relay point.

Return Policy

The customer has a cooling-off period of 14 days from the date of delivery to return the product in new and unused condition, in its original packaging, unopened and unaltered, at his or her own expense.

Any product that is damaged, incomplete, or whose original packaging is damaged or missing, will not be refunded or exchanged.

The buyer must notify us of the return by sending us a message specifying his name, the order number and the name of the product. There are two ways of sending this message: by contacting us via the “Contact us” link in the bottom left-hand corner of all Site pages, or by clicking on our email address link in the top right-hand corner of all Site pages.

On receipt, and after checking that the product is in good condition, we will proceed to refund the product (excluding shipping costs) within a maximum of 30 days, depending on the means of payment used by the customer.

Disputes and retention of title

In the event of a dispute, the purchaser shall first contact the company to find an amicable solution.

The fact that the seller does not avail itself of a breach of any of the obligations incumbent on the purchaser, governed by the present general terms and conditions of sale, shall not be construed as a waiver for the future of the obligation in question, nor of the purchaser’s right to avail itself of this breach at a later date.

The goods remain the property of the seller until payment in full of the agreed price, even in the event of liquidation, judicial settlement or transfer of responsibility.

herbsyinyang.com makes every effort to ensure customer satisfaction.

In all cases, the Site cannot be held responsible for non-compliance with the regulatory and legislative provisions in force in the country of receipt. The Site’s liability is systematically limited to the value of the product in question, at its date of sale, and without any possibility of recourse against the brand or company manufacturing the product.

If your product arrives damaged or does not work, please contact us within 3 days of delivery. You may return it within 7 days of delivery, or 30 days of shipment if the delivery date cannot be traced.

The Customer certifies that the information communicated to the Site is accurate on the day the order is placed and that he/she is authorized to place orders.
In particular, the Customer shall ensure that his e-mail address is in good working order. The Site cannot be held responsible for malfunctions in the e-mail address registered by the Customer (e.g. Customer input error, e-mail treated as spam, etc.).

The Site takes care to protect all data entrusted to it by the Customer for order processing. This data is intended solely for order management purposes, and will not be sold, given, transferred or exchanged under any circumstances.
Customers have a right of access to the data concerning them, as well as a right to modify and delete data communicated by them.

Liability

The Site cannot be held responsible for non-performance of the contract in the event of a product being out of stock or unavailable due to force majeure, disruption or total or partial strike, notably of postal services and means of transport and/or communications. In view of possible changes to the Herbs Yin Yang online store, the Site reserves the right to adapt or modify these general conditions of sale at any time.

Non-compliance with these terms and conditions of use

In the event of non-compliance with these general terms and conditions of sale, the Site reserves the right to deny the Customer access to the online store and its products or services, without the Customer being entitled to claim any compensation in this respect.

The fact that the Site has not removed the Customer’s access to the online store in no way relieves the Customer of this responsibility.
